Terms of Service

These Terms of Service (the “Terms”) govern the use of the AlertOS mobile application (identifier tech.oxoft.SOS, the “App”), provided by OXOFT, OBRT ZA INFORMATICA USLUGE I TRGOVINU, VL. ANDRII POLYVACH, ZAGREB, VRBIK III. 17, OIB: 89219595864 (“OXOFT”, “we”, “us”).

By installing, opening, or using the App, you confirm that you have read, understood, and accept these Terms. If you do not agree, do not use the App.

1. Who may use the App

You must be at least 16 years old (or older, where required by the law of your country) to use the App. By using the App, you confirm that you have reached the required age and have the legal capacity to enter into these Terms.

2. Service description

AlertOS lets you connect loved ones into a “Family” and includes the following features:

• sending an SOS signal with attached location to Family members;
• push notifications about received signals;
• voice calls within the Family with end-to-end encryption;
• adding loved ones via QR code;
• care features: notes, reminders, and routines;
• a paid Premium subscription with additional capabilities.

3. Nature of the service and no delivery guarantee

The App’s operation depends on factors beyond our control: the availability and quality of internet connectivity, mobile-network operation, Apple and Google servers, correct device settings, notification and location permissions, battery level, and the availability of third-party services.

Accordingly, we do not guarantee that every SOS signal will be delivered, delivered on time, contain accurate location, or be received by the recipient. The App is provided as a supplementary aid and should not be your only means of obtaining help in an emergency.

4. Account and security

• Registration is available via Apple, Google, or email and password.
• You are responsible for keeping your credentials safe and for all activity under your account.
• You agree to provide accurate information.
• Report any unauthorized access to your account to us without delay.

5. Rules of use

By using the App, you agree not to:

• violate the law or the rights of third parties;
• send knowingly false SOS signals or abuse the alert feature;
• add people to a Family without their consent;
• attempt unauthorized access, interfere with the App, or decompile it;
• use the App for stalking, surveillance, or otherwise causing harm.

6. Subscription, trial, and payment

• AlertOS offers a Premium subscription with monthly and annual billing; Premium applies at the Family level.
• A free trial (up to 14 days) may be provided. If you do not cancel before the trial ends, it automatically converts to a paid subscription.
• Payment is charged through your Apple ID account. The subscription renews automatically unless canceled at least 24 hours before the end of the current period.
• You can manage your subscription and turn off auto-renewal in your Apple ID settings (App Store).
• Refunds are governed by the Apple App Store policy; we do not process payments directly and do not receive card data.

Current prices and terms are shown on the subscription screen in the App before purchase.

7. Intellectual property

The App, its design, the “AlertOS” trademark, logos, software code, and content belong to OXOFT and are protected by law. We grant you a limited, revocable, non-exclusive, and non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms.

8. Third-party services

The App uses third-party services (Google Firebase, Agora, RevenueCat, Apple). Their use is also governed by their own terms and privacy policies. The processing of your data is described in the Privacy Policy.

9. Disclaimer of warranties

The App is provided “AS IS” and “AS AVAILABLE”, without any express or implied warranties, including warranties of fitness for a particular purpose, uninterrupted operation, location accuracy, and timely delivery of notifications. You use the App at your own risk.

10. Limitation of liability

To the maximum extent permitted by law, OXOFT and its representatives shall not be liable for any indirect, incidental, special, or consequential damages, nor for harm to life, health, or property arising from the non-delivery, delay, or inaccuracy of an SOS signal or any other failure of the App or third-party services. Nothing in these Terms limits liability to the extent such limitation is prohibited by applicable law.

11. Termination

You may stop using the App and delete your account at any time via Settings → Delete account. We may suspend or terminate your access if you breach these Terms. After account deletion, data processing ceases in accordance with the Privacy Policy.

12. Changes to the Terms

We may update these Terms from time to time. We will bring material changes to your attention within the App or by other reasonable means. Continued use of the App after changes take effect constitutes acceptance.

13. Governing law and dispute resolution

These Terms are governed by the applicable law of the developer’s place of establishment, unless otherwise required by the mandatory consumer-protection rules of your country of residence. The parties will seek to resolve disputes through negotiation before going to court.
